Criteria of differentiation of plunder with use of official position with the crimes provided by art. 290 and p. 5 of art. 204 of the Criminal Code of the Russian Federation

In work problematic issues of difference of the p. 3 of Art. 159 of the Criminal Code of the Russian Federation with taking of a bribe and receiving a subject of commercial bribery are considered. As a result the author comes to a conclusion about imperfection of some provisions of the Resolution of the Plenum of the Supreme Court of the Russian Federation No. 24 of July 9, 2013.
