Some problems of punishment for crimes against military service in the sphere of relations of the head and subject

The article is devoted to some problems of law enforcement activities that arise when sentencing for crimes against military service. The author analyzes an example from the law enforcement practice of the Cassation Military Court and formulates the problems that arise when considering the application of the preferential rule for offsetting punishment established by part 3 of Article 72 of the Criminal Code of the Russian Federation. The author proposes to supplement the provisions of paragraph 24 of the Resolution of the Plenum of the Supreme Court of the Russian Federation dated December 22, 2015 No. 58 “On the practice of imposing criminal penalties by the courts of the Russian Federation” in order to solve the identified problem.
