The article presents the results of studying controversial issues related to application of norms of criminal procedure law on the order of conducting preliminary hearing. The author of the article has analyzed the peculiarities of consideration the criminal cases by courts at the stage of preliminary hearing concerned the decision of exception the proofs on the case.
