Some controversial aspects of designing and the qualification of crimes against traffic safety and transport operation

Purpose: To Study some of the disputed aspects of the design and qualification of crimes against traffic safety and transport operation. Methodology: We used a dialectical, historical-legal, logical, systematic, dogmatic and comparative legal methods. Results: Expressed in this article value judgments and recommendations aimed at overcoming existing difficulties and contradictions in the design, and the emerging law enforcement practice in the classification of crimes against traffic safety and transport operation. Novelty/originality/value: The scientific value of the article lies in the fact that it is in order to systematize criminal law provisions and their application are proposed: 1) in article 263.1 of the criminal code to delete the reference to enhancing the criminal responsibility in case of non-careful crime group; 2) to combine the notes to articles of the Chapter 27 of the criminal code, because they have identical contents; 3) it is noted that it is necessary to introduce a criminal responsibility for violation of rules of use of small size vessels on water objects.
