Some issues of the Prosecutor's participation in the criminal process

The article discusses problematic issues of the prosecutor's participation in the criminal process at its various stages. The authors analyze the regulatory framework governing the prosecutor's powers, as well as law enforcement practice, revealing contradictions between the declared tasks and the actual implementation of the prosecutor's functions. Special attention is paid to the stages of initiation of criminal proceedings and judicial proceedings. There are cases of improper observance of the principle of competition and procedural balance. Based on a comparison of the Russian model with foreign approaches, proposals are formulated to reform the institution of prosecutorial participation in criminal proceedings. The work may be useful to researchers, law enforcement officers, and legislators interested in improving criminal procedure regulation.
