Uncertainty of the procedural status of relatives of victims who died during criminal proceedings

The article is devoted to one of the problems discussed in criminal procedure science-insufficient elaboration of legal regulation of the procedural status of relatives of the deceased victim. On the basis of a comparative legal analysis of the legislation of foreign States, the possibility of succession of the victim in the event of his death for reasons independent of the committed crime is considered. The study revealed gaps in the criminal procedure legislation that lead to the lack of a uniform approach in practice. Based on the analysis of normative and special literature sources, the possibility of making changes to the code of criminal procedure of the Russian Federation is justified. In conclusion, proposals are made to improve the current legislation, on the introduction of article 45.1 "Legal Successor".
