In this article, the question of the ratio of recovery of a penalty established for a breach of an obligation and interest for the use of other people's money (as a measure of liability or payment for use), questions regarding the legal nature of interest for the use of other people's money. Particular attention is focused on the practical importance, including the solution of such issues as the ratio of interest to other measures of responsibility, the need for the fault of the offender and the causal connection between the offender and losses for collecting interest.
