Illegal hospitalization in the medical organizations rendering mental health services (Art. 128 of the Criminal Code of the Russian Federation): some problems of classification and legislative regulation

The article presents the author's original approach to the resolution of debatable questions of classification of the crime stipulated by Art. 128 of the Criminal Code of the Russian Federation. The amendments to the domestic legislation are formulated. The author differentiates the personal responsibility for the illegal accommodation and illegal hospitalization to the medical organizations rendering mental health services. The subject of the crime according to Parts 1 and 2 of the Article 128 is defined.
