New economic policy in the judgments of A.G. Goikhbarga - a domestic Russian lawyer

After the October Revolution of 1917, the Bolsheviks began to purposefully introduce the principles of state structure and social relations according to the socialist political and ideological platform, including in the economic sphere, where, among other things, the nationalization of formerly private enterprises began. This turn put lawyers of the previous period of the Russian Empire in a difficult position, who had to reconsider their position on many issues of business law in accordance with the instructions of the new Soviet government. The situation was further complicated by the introduction of the NEP - the new economic policy, which allowed for a certain return to the private economy. The article presents the opinions of the Russian legal scholar Alexander Grigorievich Goykhbarg about the NEP, who, while generally agreeing with the policy of the Soviet government, at the same time expressed opinions that are of interest from a theoretical and legal point of view for modern economic relations. In particular, he believed that under the NEP, absolute freedom of contracts was unacceptable, since, given the complexity of control over numerous transactions of business entities, there would be a threat of destruction of the "economic organism of the proletarian state". The creative work of this author seems to be undeservedly forgotten, and the article presents an attempt to partially fill this gap.
