Financial obligations and contract termination

Fulfillment of the contract is the main motive why the contract parties conclude contracts. When one contract party fails to fulfill its contractual obligations, then, the other contract party which sticks to the contract, could request the contract to be fulfilled or to terminate it. The author has analyzed legal regulations relating to contract terminations resulting out of non-fulfillment of financial obligations, and he has noticed some collision among legal regulations which regulate this matter. The subject of the analysis have also been normative solutions suggested by the Preliminary Draft of Civil Code which try to remove the understatements and existing contradictions of positive - legal regulations.
