A new system of legal redress in the executive proceeding of Republic of Croatia

In a paper work the author elaborates a new system of legal redress in the Croatian civil executive proceeding. After introductory remarks there are elaborated various kinds of legal redress against the judgment of the public executor. A special attention is paid to: a) the complaint against the executive decree, b) the complaint after the expiration of time, c) the response to the complaint, d) court judgments concerning the complaint and e) anomalies in the process of implementation of distress. After that there are elaborated some kinds of legal redress against the notary public's judgment, and among this part of a paper work, there are given comments on the following: a) the complaint against the decision about the distress on the grounds of a credible document and b) the complaint against the decision about the distress in the part where a distrainor is ordered to levy a distress. A special attention is paid to distress in front of the court and the objection of the third person. In such a way one pays attention to the issue of distress adjournment too.
