The article considers the shortcomings of the legal regulation of provisions of the institute of investigative actions. The pertaining of destruction and realization of material evidence to the type of investigative actions in view of absence of their direction for the establishment of circumstances subject to proof and being important for the criminal case is critically evaluated.
