The article provides a brief analysis of the theoretical and legislative provisions revealing procedural differences, both in substance and in the legal consequences of new evidence and newly discovered circumstances in the consideration and resolution of civil cases in the courts of general jurisdiction and arbitration courts. On this basis, recommendations are made to improve this legal mechanism.
