New rules for challenging transactions on the disposal of marital property: searching for the balance of interests

The amendments to the Family Code of the Russian Federation (Federal Law No. 310-FZ of July 14, 2022) are analyzed. These amendments abolished the simplified procedure for challenging transactions with matrimonial property made without the necessary notarized consent of the other spouse. The conclusion is made about the unacceptable violation of the spouses’ interests. It is proposed to make it mandatory to enter information about the joint property of the spouses into the Unified State Register of Real Estate.
