The main issue of the article are the problems and contradictions in the text of the Resolution of the Plenum of the Supreme Court of the Russian Federation N 23 dated 13/10/2020 “On the Practice of Consideration by Courts of a Civil Claim in a Criminal Case”, related with the diversity of procedural nature of a civil claim in criminal proceedings and the statement of claim in civil proceeding.
