Moral and ethical problems of appeal of a court judgement by a prosecutor

The author analyzes the moral and ethical aspects of the prosecutor's activity in the field of appealing court decisions in criminal proceedings. The article examines the categories of “fairness” and “impartiality” contained in the Code of Ethics of the prosecutor’s office worker, their correlation with the instructions of the General Prosecutor’s Office of the Russian Federation on appealing sentences in case of “significant harmful consequences”. The paper identifies and critically evaluates not fully substantiated, in the author’s opinion, normative regulations, controversial doctrinal positions, as well as complex and ambiguous moments of the research topic. The author substantiates the importance of morality in the prosecutor’s activities when appealing court judgement, as well as the need to eliminate the existing contradictions between the norms of prosecutors’ professional ethics and criminal procedural regulation of their powers when writing submissions for court decisions to higher courts
