On the advisability of strengthening the state control over the trafficking pneumatic rifles, pistols and revolvers that are not weapons

The article analyses the legal model used in Russia for state control over trafficking products structurally similar to weapons intended to hit a target at distance, but not recognized in the Russian Federation as weapons. Based on the analysis of judicial practice in criminal cases, where the products constructively similar to weapons were the instruments for committing the crime, as well as the data on accidents resulting from careless treatment of pneumatic rifles, pistols and revolvers, the authors make the conclusion that the regulatory and protective role of the state in this area should be strengthened. The legislative changes are suggested to ensure the reliable protection of life, health and property from illegal and other dangerous methods of using products structurally similar to weapon, while maintaining a minimum and sufficient level of restriction of the rights of citizens and economic entities.
