On the classification of grounds for conducting operational-search activities

The article analyzes the purposes and legal facts underlying each of the grounds provided by law for conducting operational-search activities. It is concluded that, along with the differentiation by purpose, the totality of grounds for conducting operational-search activities can be divided into three classes according to the nature of legal facts (action, event, and state). The nature of the legal facts constituting the grounds for conducting operational-search activities and the purpose of conducting operational-search activities are interconnected and determine the limits of restrictions on constitutional rights and the legal status of individuals during operational-search activities.
