Concerning injurious-to-public violations of the defence right of a suspect (an accused)

The paper examines certain violations of the right of the suspect (the accused) to be defended. The widespread and the most injurious violations are analysed. The relevance of the research is determined by the significance of the right of defence in the system of constitutional rights of the personality in general and in the criminal trial in particular as well as by the unsolved problems of guarantees of this right. The scientific novelty of the study consists in identifying the insufficiency of the available guarantees for implementing the right of defence and the need to establish the criminal liability for its most injurious violation. Besides, the authors raise the issue of prosecuting a defence lawyer in the above-mentioned aspect.
