Concerning some features of judge's belief formation in evaluating evidence

Changes to the criminal procedure legislation emphasize the relevance of theoretical explanation and practical application of the principle of free evaluation of evidence established in the Russian Federation Code of Criminal Procedure. These legislative amendments determine transition to adversary proceedings with such main principles as freedom of evaluating evidence and presumption of innocence. The article describes the institutions of evaluating evidence and belief, taking into account the multifaceted approaches to reviewing fundamental concepts. The study proves theoretical and practical division of proving process into elements through the procedural form analysis as well as the need to establish a mechanism for the formation of the judge’s belief. The author suggests improving the selection of candidates for a judge position in order to overcome prosecutorial bias in their legal consciousness.
