About some problems of operational - search recruiting of persons concluding a contract on confidential assistance with bodies carrying out operational-search activity

The article considers the situation generated by the «lack of will» of the subjects of lawmaking as well as by conservative understanding of the prevalence of the principle of conspiracy over other principles of the operational-search activity. This situation consists in the lack of provided by law and detailed mechanism of implementation of the rights and social guarantees of persons providing confidential assistance to the bodies carrying out operational-search activities under the contract which is declared by the Federal Law «On the operational search activities» N 144-ФЗ dated 12.08.1995.
