The Criminal Procedure Code of the Russian Federation stipulates a priority protection of rights and legitimate interests of individuals and organizations, victims of a crime, as well as protection of an individual from unlawful and baseless charge, conviction and restriction of rights and freedoms. The Russian Constitution and international legal acts say about the obligation of a state to provide along with the protection, the compensation (reparation) of damage to the victims of a crime or an abuse of power, as well as the restoration of their rights. Implementation of the provisions on the protection and restoration of the rights and legitimate interests of individuals and organizations, the crime victims, ensures the typical for a jural state level of their realization in the criminal justice process. Understanding that the initiation of a criminal legal proceeding as not only protection, but also the restoration of violated rights and legitimate interests of individuals and organizations, is its purpose, allows filling of this gap in the conditions of the existing fragmentary regulation by the Criminal Procedure Code of the issues concerned with the reparation of damage inflicted by a crime.
