Several qualification issues of mitigated homicide (articles 106, 107 of the Russian Criminal Code)

The paper deals with the problematic issues of qualifying maternal neonaticide, in particular in case of complicity, and reveals the temporal aspects of the terms ‘childbirth’ and ‘postpartum condition’. The concept of an early post-natal period is determined on a case-by-case basis. Maternal infanticide, manslaughter of an infant by mother, and child endangerment are distinguished. The research examines the elements of crime of passion and identifies its mandatory components. The authors make practical recommendations to qualify this type of crime, analyze the affected intention provoked by violence, mockery, a serious insult, the illegal or immoral behavior of a victim, and investigate the duration of a psychotraumatic situation. The study will be helpful in investigating the abovementioned crimes that due to their small number pose a challenge to preliminary investigators.
