On some issues of imposition of fine under the new Administrative Procedural Code of the Republic of Kazakhstan

The attention is drawn to the broad discretion of a judge in deciding issues related to the imposition of fine for violation of the norms of the new Administrative Procedural Code of the Republic of Kazakhstan. The Code does not enshrine the grounds for reduction of fine, exemption from its payment, installment, deferral, the author considers that it is necessary to correct this gap. The author proposes to include the grounds for reduction of fine, exemption from its payment, installment, deferral either directly in the Administrative Procedural Code of the Republic of Kazakhstan or in a special normative resolution of the Supreme Court of the Republic of Kazakhstan. This action will allow eliminating corruption of norms in this part of law and forming stable and effective work of new specialized inter-district administrative courts, which will start working from July 1, 2021.
