In this research paper, the issue of returning the right to initiate criminal proceedings to the prosecutor is considered. The author, based on the study of legislation, judicial practice and statistics, as well as scientific works, argues in favor of giving the prosecutor the right to initiate criminal proceedings. Also in this work, the author justified that the prosecutor is limited in the rights to supervise the preliminary investigation bodies, namely, in the part concerning the illegal refusal to initiate criminal proceedings, in connection with which the prosecutor cannot fully protect the rights of persons who have suffered from a crime from illegal actions of the preliminary investigation body.
