About new ways of committing crimes using personal data

The relevance of the article is confirmed by the catastrophic growth of crimes with personal data as a new segment of ordinary crime. Based on examples of investigative and judicial practice, scientific publications on the topic and media information, an original analysis of new trends in criminal trafficking of personal data is given. Attention is drawn to the significant transformation of this type of crime, which is expressed in the emergence of new ways of seizing and using personal (biometric) human data through modern technologies (deepfake). The subject of the study was the norms of domestic criminal legislation, draft laws related to the protection of personal data, investigative and judicial practice in the studied category of cases, indicators of official crime statistics of the Prosecutor General’s Office of the Russian Federation and leaks of personal data of Roskomnadzor of the Russian Federation, media reports on crimes related to obtaining and (or) using someone else’s confidential information. The methodological basis of the study was determined by its subject matter. It was compiled by methods of analysis and synthesis used to describe new ways of committing crimes with personal data; statistical and documentary, which made it possible to study scientific papers, statistics on incidents with personal data leaks and investigative practice. The formal logical method was used to describe the results of the study and formulate its conclusions. The results of the study include the identification and description of new ways of committing crimes against personal data and using them, including the active use of human biometrics (voice, image). The obtained results can be used to formulate forecasts of the development of the considered type of crime and criminological risks of personal data. The conducted research allows us to conclude that crime with personal data is constantly being transformed using modern in-formation technologies and artificial intelligence; illegal trafficking of personal information about a person who is freely available has a high degree of public danger due to violations of his rights and freedoms in the case of deanonymization.
