The article is devoted to the problems of legal regulation of evaluation concepts in criminal law of Russia and the Republic of Abkhazia. The article focuses on the practice of the courts in crimes, in which emotion is a featured whole. While the author makes proposals to improve the legislation and practice of its application, both in Russia and in the Republic of Abkhazia.
