About the concept of subjects of the social power in labour relations

In this article the concept power and its carriers – subject’s public, including labour relations is revealed. A number of aspects of expression of the power are designated. Subjects of the social power in labour relations as which act the state, employers and social partners (in case they establish working conditions of workers) are defined. It is claimed that the state as public and imperious formation, acts as the main carrier of the social power in the public relations arising in the area of wage labour which realization has to serve a main goal is protection of the worker against deterioration of its social and financial position. Separately the version of this social phenomenon – the master’s power of the employer is called. Three aspects of expression of the master's power of the employer are allocated: the employer has the standard power, being expressed that the worker is obliged to submit to employment policies and procedures and other local regulations; the employer possesses the administrative power, being that the worker is obliged to submit to orders and instructions of the employer if the rights of the worker thus are not violated; the employer possesses the disciplinary power that finds reflection in a duty of the worker for a disciplinary offense and (or) the material offense which is expressing in a property tort of the employer or other persons of a measure of responsibility, which are established by the law, with observance of the procedures are provided by the law. The conclusion that allocation of subjects of the social power in labour relations and definition of their signs allows to reveal possible mechanisms of abuse of the similar power from their party that finally leads to deterioration of a legal status of workers and allows to provide instruments of protection of labour rights of workers from their arbitrariness.
