On the conceptual framework of control and supervisory activities of executive authorities

The subject of the article is the analysis of the concepts of control and supervision, tasks of state control, signs of control and supervision; different authors’ positions on the relationship between the concepts of control and supervision are examined. The authors turn to the question of legal regulation improvement of control and supervision in the Russian Federation. It is specified that one part of supervisory functions can not be implemented towards certain types of state (municipal) control and supervision due to ambiguity of assigning a state (municipal) control and supervision to the regulation by the Federal Law of 26.12.2008 № 294-FL "On protecting rights of legal entities and individual entrepreneurs when exercising state control (supervision) and municipal control". In this regard, anticipated step in the development of the studied institute is the revision of the draft Federal Law "On fundamentals of state and municipal control (supervision) in the Russian Federation" by the Ministry of economic development. The new law should be aimed at improving the system of evaluating the effectiveness of control and supervision activities, implementation of systems for regulatory bodies to promote economic activities, introduction of a risk-based approach in order to conduct audits, strengthening of social control, increasing the transparency and the accountability of control and supervisory bodies.
