On the problems of establishing guilt in law enforcement

The author analyzes the features of establishing guilt in the course of law enforcement activities. It is concluded that the concept of "guilt" is very closely related to other equally important criminal law institutions: insanity, affect, innocent harm, the state of necessary defense and others. The analysis of judicial practice has shown that judicial errors are often made precisely in those cases in which the above-mentioned criminal law institutions take place.
