The relationship between the concepts of law enforcement error and failure in enabling legislation (a theoretical and legal analysis)

The research analyzes the legal concepts of law enforcement error and failure in enabling legislation. These categories are not codified, and the doctrines interpret them in different ways. It poses additional challenges to both theorists and practitioners to use these terms properly. Having generalized the opinions of scientists, the author revealed the significant differences in the semantic content of the concepts of law enforcement error and failure in enabling legislation. It is concluded that an error can occur at any stage of the enforcement process, but it is not always recorded in the enactments while failure in enabling legislation is possible not only because of law enforcement errors.
