Concerning some additional proceedings in the Russian criminal process

The article substantiates a theory, saying that essence of the legal activities under some additional proceedings is not of the criminal procedure nature, but the logistical one. The process of the judgement adjustment in accordance with the criminal law promulgation is not focused on the estimation (establishment) of the new circumstances, and thus is not of the criminal procedure nature as a matter of fact. The participation of the prosecutor and other legal procedure parties in the matter under inquiry is merely formal.
