Concerning the law of intercoupling between private and public legal principles of discretion in judicial jurisdictional process

Reasoning from the dualistic nature of discretion in the judicial jurisdictional process, the author uses the level approach to the analysis of legal interaction of its private legal and public legal principles. On the basis of the legal description of interdependence of the discretion powers of the parties, other participants and the court, the article formulates theoretical law of intercoupling of private and public legal principles of discretion in the judicial jurisdictional process.
