On importance of legal positions of the Constitutional Court of the Russian Federation for application in family legislation

Legal positions of the Constitutional Court of the Russian Federation, contained in the motivation part of its decisions, hold a special position among the estimating categories used in law enforcement, as they gloss the constitutional norms or disclose constitutional meaning of individual regulations of branch legislation. It is generally recognized that legal positions, on which conclusions of the Constitutional Court are based in resolutory part of its decisions, are binding for all public agencies and officials, have a general legal effect and over-branch legal regulation potential. However, legal positions of the Constitutional Court on issues originated in the practice of application of family legislation are usually reflected in the motivation part of decisions of the Constitutional Court, in which consideration of complaints of citizens from violation of their constitutional rights by individual provisions of Family Code of the Russian Federation is rejected, in particular by art. 34, art. 36, art. 37, art. 44 and art. 46 of Family Code of the RF. The given decisions of the Constitutional Court reflect the essence of disputes and interpretation of the constitutional meaning of provisions of the branch legislation applied at consideration of such disputes. In virtue of the mentioned unity of regulatory and doctrinal principles, the legal positions of the Constitutional Court expressed in judgments of rejection of adjudication of complaints initiated by disputes related to enforcement of property rights by married couples, studied by the author, take on special importance for law-enforcement practice. The author believes that the investigated legal positions of the Constitutional Court have to be directly applied by courts in the course of adjudication disputes on severance of a jointure of married couples, that will make a contribution to constitutionalization of the judicial practice.
