On the significance of the victim's traits while characterizing the objective side of crime

In the study of the objective side of crime, such essential elements that characterize the situation, modus operandi and consequences of committing a crime take on particular significance. These essential elements are required to be established, because their absence complicates the definition of components of crime. However, the victim’s characteristics have never been considered as an independent element of the objective side. At the same time, the analysis of criminal law shows that the victim’s characteristics (personality, behavior, condition, relationships with the guilty person, damages) often appear in connection with other essential elements of the objective side. With all this, the victim’s traits characterize such signs of the objective side as the situation (behavior, condition, mutual relations), modus operandi (use of the state and relationships) and consequences (essential elements of damages).
