The etymology of the concept "utilitarianism" goes back to the concept "utility". The contrastive-comparative analysis of Russian and English versions of the concept "utilitarianism" suggests that the etymology of the concept "utilitarianism" can be oversimplified through the following series of concepts "utility" - "benefit" - "relief" ("calm") - "tranquility" - "joy" - "pleasure" - "happiness". In close interrelation with the genesis of the concept "utilitarianism", it is possible to carry out a theoretical analysis of the use of law as a form of implementation of law, because every certain set of symbols conceals conceptions of a particular object of the material world, phenomenon or any other subject, thought, idea. In addition, the content of this concept is associated with the very concept. The link between them should be traced clearly, in order to simplify the process of communication, reduce transaction costs of information transfer. The author of the article believes that due to this link language usefulness as such increases.
