About the determination of the size of liability of the parties particular to road transport accidents under the influence of road conditions

Purpose: The use of the mechanism for determining the responsibility of the parties involved in an accident due to road conditions in practice and to develop proposals for improving its effectiveness. Methodology: This article used normative legal documents. Results: With the help of mathematical apparatus of the theory of risk we can determine the probability of an accident because of the actions of the driver or road services. This probability can be considered as the measure of responsibility of each party, helping to justify the proportions for damages. Novelty/originality/value: The article deals with the definition of responsibility of parties involved in road traffic accidents occurring under the influence of the road conditions. Currently, however, research expertise in the civil process almost do not use probabilistic methods of mathematical modeling to justify the degree of responsibility of road services and drivers.
