Object as a feature of encumbrance distinguishing it from restrictions in the private law of the Russian Federation

The article reveals a problem of encumbrance of property being both on the property right, and on other right of the third parties. The author represents the comparative analysis of two concepts – "encumbrance" and "restriction". The conclusion that one of distinctive features of the specified concepts is the object of their influence that the thing is subject to encumbrance, and to restriction – the right is drawn. Thus the author notes that the property, not only being on the property right, but also on other right of the third parties is subject to encumbrance.
