Enforcement of foreign citizens’ rights in Russia: problematic aspects

In part 3 of article 62 of the Russian Constitution it is stated that foreign citizens and persons without citizenship in the Russian Federation exercise rights and bear liability on a par with Russian citizens, except the cases established by Federal law or international treaty of the Russian Federation. However, there are many problems associated with foreign citizens’ rights protection. Currently, the need for migrants’ integration and adaptation is discussed; however, the issues of the result of this integration and of a future integrated immigrant remain unresolved. The problems of enforcement and protection of foreign citizens’ rights are not so much in law as in law enforcement. It is difficult for foreigners’ to exercise their social rights generally because it is intended to provide social services only to individuals who have either temporary or permanent registration. To solve these problems it is proposed to adopt measures in the area of ​​integration, adaptation and protection of foreign citizens’ rights in the Russian Federation.
