Explanation as a source of evidence at the stage of initiation of a criminal case: statement of the problem

The article is devoted to the problems of using as evidence in a criminal case the explanations obtained during the verification of a crime report. The author analyzes various points of view regarding this issue, makes some suggestions for improving the criminal procedure rules governing the process of proof. In addition, the author concludes that it is necessary to use the information contained in the explanations in proving criminal cases, provided that it complies with the principle of evaluating evidence, from the point of view of their relevance, admissibility, reliability and sufficiency, as well as the possibility of using the rights and guarantees directly affecting its interests by the participant in the verification.
