Consideration of cases by a Confucian judge and court trial are regarded as competing jurisdictions. And, the transition of modern Chinese society to state jurisdiction in the sphere of criminal prosecution of dangerous offenders was expected. The scales of history was trembling between the humanity and compassion for an ordinary person who found himself in a difficult situation and was forced to commit an offense, and the modern principle of legality. In the article, we focus on the transformation of modern Chinese society and further paths of its development, describing the core confucian values in the field of criminal and criminal procedural law.
