Social Danger of a Crime and its Mathematical Assessment

The relevance of the topic is confi rmed by the need for scientific research of the legislator’s assessment of the typical public danger of crimes inherent in the sanctions of the criminal law. To accomplish this task, a mathematical method was chosen due to the presence of quantitative characteristics included in the types of punishments given in the Special Part of the Criminal Code of the Russian Federation in relation to each crime, i. e. due to their measurable estimate. In addition to general logical methods, metaphysical and mathematical methods, as well as the method of scientific modeling are used in the paper. The views of N. F. Kuznetsova, A. I. Martsev, N. S. Tagantsev, and A. D. Nechaev lead us to the conclusion mathematical model for assessing the public danger of a crime`s possibility, provided that the sanction reflects the degree of public danger of a crime through the needs of society with minimal voluntaristic tendencies in legislative decisionmaking. The analysis of the evaluation of the social danger of a crime depending on the object of the encroachment is carried out. The calculations are based on the example of measuring the social danger of aggravating circumstances. The study showed that a mathematical assessment of the public danger of a crime is possible. It is proposed to create a computational program for determining a more accurate diapason of the type and extent of punishment, which can be used for practical purposes and become an effective tool for anti-corruption policy. This program can also be used for educational purposes.
