The article deals with several controversial issues about the usage of customary law in international law. Uniformity of state practice and opinio juris (a belief that a rule constitutes a legal obligation) - the two essential elements of international custom are examined. A brief analysis of case law of the International Court of Justice on the matter supports conclusions of the author.
