The assessment of the sufficiency of the grounds for initiation of criminal proceedings on the fact of the illegal sale of drugs in case of lack of the subject of a crime

The article considers the problem of assessing the sufficiency of the factual basis for the initiation of the criminal proceedings. The author substantiates the position that a proper assessment of factual evidence and making up a lawful and reasoned decision on initiation of the criminal proceedings largely depends not only on the professionalism and integrity of officials responsible for conducting verification of reported crimes, but also on the state of legal regulation in this area. The author comes to the conclusion that there is a significant number of gaps and contradictions in the legal regulation of investigators' and interrogators' activities at the stage of initiation of criminal proceeding, and this fact indicates the necessity of introducing the relevant changes into the Criminal-Procedural Code of the Russian Federation.
