Restriction of human rights as a mechanism for implementing national security

In the modern geopolitical situation, the problem of ensuring Russia’s national security is fundamental. The main element of its implementation is the institution of limiting the rights and freedoms of man and citizen included in the design of special legal regimes enshrined in military, emergency, anti-terrorist legislation limiting the rights of some citizens to ensure the safety of the majority. A comparative analysis of the norms of the Federal Constitutional Laws “On Martial Law”, “On the State of Emergency”, the Federal Law “On Counteracting Terrorism” leads the author to conclude that the latter has constitutional status, and that further legislative regulation of the emerging special counter-corruption regime is necessary.
