The author examines the controversial issues of the auction in the form of competition. It analyzes the problem of requiring the presence of experience as a criterion for determining the winner of the contest for the entities engaged in entrepreneurial activity. He comes to the conclusion that the establishment of such criteria as the presence of expertise for legal entities and individual entrepreneurs, it is inappropriate and incorrect theoretically more correct would be to establish the criterion of having the experience for the employees of the legal entity or individual entrepreneur, who will be involved in the execution of works.
