Mobile phone inspection: unresolved law enforcement issues

The relevance of knowing the sequence of mobile phone examinations is determined by the fact that they are directly related to to improving the efficiency and quality of crime investigations, including crimes committed through the use of information and telecommunication technology or computer information. On the basis of the analysis of the law of criminal procedure, judicial and investigative practice, the positions of scientists and criminologists formulated recommendations for mobile phone inspection, presented as a set of sequential organizational and tactical actions. On the basis of the analysis of the Constitution of the Russian Federation, the Universal Declaration of Human Rights, the law of criminal procedure, decisions of the supreme judicial bodies of the Russian Federation, positions of scientists in the field of criminal procedure, criminalistics and operative - investigative activity the author's opinion on the problem of observance of constitutional human rights during examination of a mobile phone is presented.
