Bases for test purchase drugs and criteria of its substantiality

This article examines the problem of assessing the adequacy of the grounds for conducting a test purchase of narcotic drugs. Based on the analysis of the decisions of the European Court of Human Rights, the Supreme Court of the Russian Federation adopted in criminal cases, in which the materials of the verification purchases of narcotic drugs were featured, the author suggested possible ways to establish the sufficiency of the grounds for its holding. The concept of the reasonableness of carrying out operational-search measures and its criteria are considered and disclosed. Proposals are being made to improve legal regulation and the procedure for conducting drug test purchases.
