Grounds for denying state support to agrarians: problems of legality and gaps in existing legislation

Purpose: To work out ways of resolving some legal incidents arising in the process of law enforcement in the field of insurance of agricultural crop yields, carried out with state support, which creates legal certainty and improves the institution of Russian insurance law with the goal of stabilizing the legal status of farmers. Methodology: Scientific methods of analysis, synthesis, induction and deduction, and also formally legal method and method of studying of the documents were used. Results: As a result of the right-theoretical analysis and investigation of law enforcement practice in this field of scientific knowledge, it is revealed that the existing gaps in the current legislation of Russia in this sphere weaken the position of farmers as the parties to the crop insurance contract. The ways suggested by the author to solve the identified problems allow to stabilize and strengthen the position of agrarians in these insurance legal relations and, accordingly, to expand the segment of insurance provided with state support. Novelty/originality/value: The article has a high scientific value, because it is one of the first scientific works, which are an attempt to eliminate the «white spots» of the current legislation in the sphere of legal relations in question.
