Basic problems in attracting persons to criminal responsibility provided by art. 234.1 (illegal trafficking of new potentially hazardous psychoactive substances)

The article analyzes the issues of legal regulation of the turnover of new potentially dangerous psychoactive substances in the Russian Federation and the problems of the practice of applying article 234.1 of the Criminal Code of the Russian Federation. The work used statistical, retrospective, comparative, systematic research methods. The magnitude of the threat of the spread of the test substances in the context of national security is assessed, key characteristics and a retrospective of the popularization of NPVOs in the world drug market are examined. As a fundamental problem in bringing persons to criminal responsibility, provided for in Article 234.1 of the Criminal Code, indicates the absence of Resstra NPOPV.
